Scheduled inspections of DSNOs will be carried out according to new rules: a draft law is being drafted

The State Emergency Situations Service has sent to the DRSU an urgent agreement on a revised draft law "On Amendments to Certain Legislative Acts of Ukraine on the Methods of Conducting State Supervision (Control) in the Field of Man-caused and Fire Safety"

The State Service for Emergencies sent and for the urgent approval of the State Tax Administration drafted a draft law "On Amending Certain Legislative Acts of Ukraine on the Methods of Conducting State Supervision (Control) in the Field of Man-made and Fire Safety."

In particular, it is proposed to make changes in item. 49 of the Code of Civil Protection . For them, the insurance of civil liability of business entities for damage that may be caused to third parties or their property as a result of an emergency caused by a fire, accident, disaster or a dangerous event that may occur on the property belonging to them on the right property, possession or use will be voluntary.

A typical voluntary insurance contract, as well as an act of inspection of the property and an application for insurance, will be developed and approved by the National Financial Services Commission and the DSNC. A model contract must contain:

  1. the minimum amount of the sum insured, including the limits of the insurer's liability for a separate insurance risk;
  2. Definition of insurance cases;
  3. exclusion from insurance cases;
  4. order of insurance payments;
  5. requirements for the validity period of the insurance contract.

 

Impact of voluntary insurance on planned inspections

Article 66 of the Code of civil protection plans to be supplemented with new parts.

Scheduled inspections of business entities with medium and low risk levels are not carried out in the event that the subjects of economic activity are provided before the review of the contract of voluntary civil liability insurance.

!! During the award of the contract, planned inspections will not be conducted during the validity period of the said insurance contract, but not more than 10 years.

 

To whom the DSNU will come to the test regardless of voluntary insurance

  • enterprises, institutions, organizations of state and communal ownership.

 

What will be for lack of access to inspections?

For the new Part 4 of Art. 66 of the Code in the case of non-verification of the SSNS, have the right to apply to the administrative court for the obligation of the entity to grant access to a scheduled or unscheduled audit.
