The State Regulatory Service of Ukraine clarified the controversial issues regarding the planned inspections of the SNSS

At the time of the establishment of the Plan of comprehensive measures of state supervision (control) for 2018 and the Annual plan for the implementation of the state supervision (control) of the State Emergency Services for 2018, the old Criteria for assessing the degree of risk from the conduct of economic activities and the frequency is determined implementation of planned state supervision (control) in the field of technogenic and fire safety. Therefore, many enterprises were included in this plan of inspections with high risk status.

With the participation of the State Regulatory Service of Ukraine, the risk criteria have been revised and, to date, less risky entities have entered the high-risk group. Many of those previously considered highly risky have now become at risk with a medium to low degree. However, in the 2018 State Control Complex (Control) Plan, they still appear as high-risk objects because the plan was formed according to the old Criteria.

The SNS was partially withdrawn from under the action of the moratorium, but not all planned inspections, but only in relation to the health and recreation facilities for children, boarding schools, pre-school institutions, general secondary education, vocational (vocational) education, specialized education, as well as sub High-risk economic entities (including objects of fuel and energy, military-industrial complexes, objects of high danger, chemical-dangerous objects and objects of high-rise construction).

Here many questions arise from the entrepreneurs. One of them - new or old. Criteria for risk should be managed?

The DCS position is as follows.

As the resolution on the exclusion from the moratorium (Resolution of the Cabinet of Ministers of Ukraine "On approval of the list of bodies of state supervision (control) not covered by the Law of Ukraine" On Temporary Peculiarities of Implementation of Measures of State Supervision (Control) in the Sphere of Economic Activity "of December 18, No. 1104 came into force on 02/23/2018) was adopted already after the approval of the new Risk Criteria, then scheduled inspections may be conducted in the case when the subjects are in a high risk group both for the old and for the new Risk criteria.

Therefore, RDF experts believe that scheduled inspections can be carried out in the event that the entities are in a high-risk group both in the old and in the new Risk Criteria.

What to do with an entrepreneur?

Check the extent to which his enterprise belongs according to the new risk criteria , approved by the Resolution of the Cabinet of Ministers of Ukraine dated December 27, 2014 No. 1043, which came into force on December 29, 2017;

If under the new Risk Criteria an entity does not relate to a high risk, but the Plan of comprehensive state supervision (control) plans for 2018 provides for a planned inspection of its enterprise, then it has the right not to allow verification , since it is distributed to it moratorium.

The response of the DSNC will be a confirmatory document that will certify to which degree of risk criteria the entity relates and whether verification can be carried out.

If, after receiving the explanations of the State Service of Ukraine for Emergencies, the entity remains in doubt as to compliance with the requirements of the current legislation by the state supervision body (control), we propose to the economic entities to apply for clarifications to the State Regulatory Service of Ukraine .
